Hearing to Discuss Adequacy and Compliance of NES

CANBERRA — The Australian government is set to present its stance on the National Employment Standards (NES) during a public hearing by the House of Representatives Standing Committee on Employment, Workplace Relations, Skills and Training this Thursday, 26 March 2026. The committee aims to evaluate the adequacy and operation of the NES, which form the foundation of employment conditions in Australia.

The inquiry, initiated on 27 November 2025 by the Minister for Employment and Workplace Relations, Amanda Rishworth MP, seeks to assess how well the NES safeguard employee entitlements and ensure compliance. According to Dr Carina Garland MP, the Committee Chair, the hearing will shed light on whether the NES remain effective in 2026 and identify potential challenges in accessing minimum entitlements.

Details of the Public Hearing

The hearing will involve testimonies from the Department of Employment and Workplace Relations and the Fair Work Ombudsman. It aims to explore government perspectives on the NES and their role in the broader economic landscape. The session will take place from 9:00 am to 10:00 am in Committee Room 2R2 at Parliament House, Canberra, and will be available for live streaming at aph.gov.au/live.

This inquiry comes at a time when workplace standards are under increased scrutiny, reflecting a broader trend towards enhancing worker rights and conditions across various sectors. The focus will be on whether current laws and regulations adequately protect workers while supporting economic growth.

The inquiry will consider submissions from various stakeholders, including trade unions, employer groups, and academic experts. These contributions are expected to provide a comprehensive view of the existing framework and suggest improvements. The government has expressed a commitment to ensuring that the NES continue to meet the needs of a dynamic workforce, adapting to changes in technology, industry practices, and international standards.
